Draft version 2026-09-06 · legal review incomplete

Terms of use

CarPacta helps parties collect and preserve facts. These draft terms separate the platform service from the vehicle sale and from individual legal or technical advice.

Commercial launch is blocked

The provider’s real legal name, registration number, address, contact details and VAT status must be published before accepting payments.

1. Service

CarPacta prepares and stores a digital vehicle transaction and evidence case. It is not a vehicle seller, buyer, broker, insurer, warranty provider, workshop, expert, lawyer or dispute-resolution authority.

2. Scope

These terms apply to the account owner, invited transaction party and authorised reviewer. The vehicle sale remains between buyer and seller. Mandatory rules differ between consumer–business and private-party transactions.

3. Free and paid scope

For €0, users can enter vehicle information and prepare files. The one-time €29 transaction-case activation is intended for buyer participation, final documents, locking, handover, export and later claims. External VIN checks and qualified signing apply only after the relevant production providers are active. A separate one-time €20 dispute-case preparation service is intended for a post-sale dispute where no earlier CarPacta transaction case exists: chronology, later documents, next-step guidance, export and the claim workflow. Neither product is a subscription or payment for the vehicle.

4. User duties

Provide accurate information, mark unknown facts clearly, do not falsify files, and upload only content you may lawfully process and disclose. Do not upload unnecessary identity numbers, card data, access codes or unrelated third-party information.

5. Evidence and signatures

Checksums, versions and timestamps help verify integrity; they do not prove every statement is true. Email or OTP confirmation is not a qualified electronic signature. A signature is described as qualified only after a valid result from an eIDAS trust-service provider.

6. Vehicle limitations

CarPacta preserves photos and videos with sound but does not automatically diagnose a fault, its cause, timing or responsibility. External data is displayed with its source and coverage; no record does not mean no damage.

7. Legal information

The service may provide general process information, questions and document drafts based on user-supplied facts. It does not decide who is right, provide an individual legal opinion or guarantee an outcome. High-value, complex or court-bound documents require a lawyer.

8. Buyer rights

No button, review, signature or “no claims” wording removes mandatory statutory rights or validates a concealed defect. CarPacta records what was disclosed and confirmed; legal consequences are determined by the parties, competent authority or court.

9. Distance contract and withdrawal

A consumer generally has 14 days to withdraw from a distance service contract. Before performance starts during that period, CarPacta asks separately for an express request to begin and acknowledgement of any proportionate charge permitted by law.

The withdrawal right may end after full performance only where the legal conditions and the consumer’s prior express consent and acknowledgement are satisfied. Accepting the general terms alone is not treated as sufficient.

A clearly labelled withdrawal action remains available in the footer and account settings. Submission is time-stamped and retained even if delivery of its email receipt fails.

10. Price, payment and refunds

The final price and applicable taxes are shown before payment. A licensed provider processes payment; CarPacta does not store full card details. Lawful refunds are normally returned using the original payment method.

11. Availability

CarPacta may perform maintenance or restrict malicious use. Access to documents already confirmed by both parties must not be removed merely because of a later payment dispute.

12. Intellectual property

You retain rights in submitted content and grant only the rights needed to store, process, show it to authorised participants and export it. Case contents are not used for public model training or advertising without a separate lawful basis.

13. Liability

Limitations do not apply where prohibited by mandatory law, including intentional misconduct, gross negligence and mandatory consumer rights. CarPacta is not responsible for the parties’ transaction decision or false information, but remains responsible for its own service obligations under applicable law.

14. Complaints and changes

Contact pagalba@carpacta.lt. Consumer complaints about the CarPacta service are handled free of charge; where applicable, a reasoned written response and the competent ADR body are identified within the statutory process. Unresolved Lithuanian consumer disputes may be referred to VVTAT or a competent court. Material changes are notified in advance, while a locked case retains the terms and consent version applicable at locking. This remains a draft pending Lithuanian counsel review.
